1. Acceptance of Terms

By creating an account, placing an order, or otherwise using The Hungry Gujju platform, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. These Terms constitute a legally binding agreement between you and The Hungry Gujju, operated from Ahmedabad, Gujarat, India.

2. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate and complete information during registration.
• You are responsible for all activities that occur under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
• You must notify us immediately of any unauthorized use of your account at support@thehungrygujju.com.

3. Orders & Payments

• All prices displayed on the platform are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.
• Payments are processed securely through Razorpay. We accept UPI, credit/debit cards, net banking, and digital wallets.
• The platform holds payment from customers until order fulfillment is confirmed. Vendors receive payouts on a monthly basis after commission deduction.
• We reserve the right to refuse or cancel any order at our discretion, including orders suspected of fraud, pricing errors, or stock unavailability.
• An order is confirmed only when you receive a confirmation email from us. Adding items to your cart does not constitute an order.

4. Shipping & Delivery

• Shipping is free for orders above Rs. 4,999. Standard shipping charges apply for orders below this amount.
• Estimated delivery is 3-5 business days within Gujarat and 5-7 business days for the rest of India.
• Delivery timelines are estimates and may vary due to unforeseen circumstances, weather, or logistical delays.
• Risk of loss and damage passes to you upon delivery of the product to the shipping carrier.
• You are responsible for providing an accurate and complete delivery address. We are not liable for delays or non-delivery due to incorrect address information.

5. Returns & Refunds

• Returns are accepted within 7 days of delivery for damaged or wrong items only.
• To initiate a return, contact support@thehungrygujju.com with your order number, photos of the damaged/wrong product, and a description of the issue.
• Refunds will be processed within 5-7 business days after the return is approved and will be credited to the original payment method.
• Returns due to change of mind, taste preferences, or opened/partially consumed products are not eligible.
• Perishable items have a shorter return window. Please inspect all perishable items upon delivery.

6. Vendor Terms

• All vendors must hold a valid FSSAI license or registration to list food products on the platform.
• Vendors are responsible for the accuracy of product information, including descriptions, ingredients, pricing, and images.
• A platform commission is deducted from each sale. The commission rate is communicated during vendor onboarding and may be updated with prior notice.
• Vendor payouts are processed on a monthly basis to the registered bank account after commission deduction.
• Vendors must maintain product quality, adhere to food safety standards, and ship orders within the agreed timeline.
• We reserve the right to suspend or remove vendor accounts that repeatedly violate quality standards, receive customer complaints, or fail to meet FSSAI requirements.

7. Intellectual Property

All content on The Hungry Gujju platform, including but not limited to the logo, design, text, graphics, and software, is the property of The Hungry Gujju and is protected by Indian intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent. Vendors retain ownership of their product images and descriptions but grant us a non-exclusive license to display them on the platform.

8. Limitation of Liability

• The Hungry Gujju acts as a marketplace connecting vendors with customers. We are not the manufacturer or direct seller of products listed by vendors.
• We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of our platform or products purchased through it.
• We do not guarantee the accuracy of product descriptions, images, or claims made by vendors.
• Our total liability to you shall not exceed the amount paid by you for the specific order giving rise to the claim.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the platform after any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
